Since the end of the last military dictatorship in Argentina, the discussion about the criminal nature of the acts perpetrated from the State during that period has lasted. Motivated to answer that question, Martín Lozada offers an analytical journey that goes from international criminal law to the specificity of the local debate.
In the first part of this book, the author assesses the characteristics of the complex of crimes against humanity and, in particular, crimes against humanity and genocide. For this, not only investigates the technical-legal conformation of these figures, but seeks to explain, beyond the letter of the law, what human tragedies demanded its theoretical construction.
In the second part, the Argentine case is focused on: «the genocidal nature of the acts perpetrated by the State power holders is seized, usurped by maneuvering and carried out by the military power – and its civilian collaborators – from the day March 24, 1976. Evaluate the scope of that statement and verify if, in effect, the development experienced by certain branches of law gives reason, also responds to the objective set »in this work, explains the author.
