Discontent in the legal profession. Tensions between the personal and professional ethics of lawyers

El malestar en la profesión jurídica. Tensiones entre la ética personal y la ética profesional de los abogados

There are two purposes to El malestar en la profesión jurídica: the first is to explore and reveal, through fieldwork in Bogotá, the tensions that lawyers experience between their personal or common ethics and the demands that professional ethics place on them to fulfill their particular role as lawyers. The second is to investigate the reasons why these tensions have remained in the shadows both for practicing lawyers and for Colombian legal academia, which has shown little interest in the issue of professional ethics. Through rigorous and critical legal analysis of the norms and jurisprudence in the field of professional ethics of the Colombian lawyer, as well as a number of particular concepts of psychoanalysis such as defense mechanisms, trauma, guilt, and moral masochism, this book explains why, despite the fact that tensions between personal and professional ethics and feelings of guilt are very common in legal practice, lawyers also enjoy them, while academia remains impassive and silent in the face of this phenomenon.
