The purpose of this book is to present, in a systemic way, bases for a general theory of the copyright contract. Since the 19th century, intellectual property laws and treaties have focused on the static protection of the author, granting patrimonial and extra-patrimonial rights. However, in the current context, it is necessary to identify the rules that will allow the dynamic protection of the author, that is, the protection at the moment of negotiating and concluding contracts on the authorial rights that they have over their work. The author is a vulnerable subject, who requires special protection in the contractual field. The Latin American law is analyzed and the rules of copyright’s general theory of the contract, are presented in an orderly manner.
