The absence of supranational rules on e-commerce in the Andean Community hinders its progress in the region. The Member States have had the global reference of the model laws of the United Nations Commission on International Trade Law (UNCITRAL), which are a prototype for possible legislative adjustment, with the possibility of adaptation when they are introduced into the respective legal systems. However, as an indication, the degree of harmonization that can be achieved with the model laws on electronic commerce is uncertain.
This research begins with a historical and conceptual approach to the uniform law for international trade; it continues with the main actors and their legal instruments; it then analyzes the standardization of e-commerce; and concludes with the effectiveness of UNCITRAL model laws for e-commerce harmonization in the Andean Community.
