This collective work is part of the investigation called: “Limits to the autonomy of the will in Wraps contracts”. The study is based on the need to analyze in the national and international context the application and regulations of the new forms of contracting through web portals: Wraps contracts. These legal figures have been developed in Anglo-Saxon Law, but their usefulness has spread to the entire globe, thanks to the development of ICT (specifically, the Internet). These new contractual forms have generated benefits for economic development and the circulation of goods and services and have been enshrined through electronic commerce and contracting. However, derived from its application, there have been various doctrinal debates about the limits that can be set in relation to the autonomy of the contracting parties, since they can only express their consent through electronic mechanisms, without any negotiation and, on certain occasions, without previously knowing the terms of the contract. National legislations do not present clarity on this subject and the doctrine has not provided a precise answer on these phenomena, which arise from the new globalized trends of Law. Therefore, it is necessary to carry out an investigation that demonstrates the legislative inconsistencies that the Colombian regulations present, in a particular way, to make a concrete proposal before the problem raised. This book has been addressed from four major themes: 1) theories of the perfection of Wraps contracts, 2) the protection of consumers in legal relationships derived from Wraps contracts, 3) the limits to the autonomy of the will in the Rome I Regulation on the law applicable to contractual obligations (special reference to the cases of electronic contracting) and 4) the contributions of the alternative solution of contractual controversies to the development and interpretation of Wraps contracts.
